The highest award for a birth injury case was approved by the High Court today

After accepting liability for negligence during the delivery of a boy from Birr, Co Offaly, the HSE settled its case with his mother for 30 million euro.

Oran Malloy suffered catastrophic injuries due to a lack of oxygen during emergency C section birth at Portiuncula Hospital, Ballinasloe, Galway on New Years Eve 2006.

His mother, Deirdre was admitted the day before, she was eight months pregnant.

Oran was unresponsive when he was born and he was later diagnosed with cerebral palsy.

Now 14 he can't walk or stand unaided, he needs crutches and a wheelchair to get around.

The 30 million euro settlement approved today brings an end to what the family solicitor described afterwards as a 14 year battle.

Julian O'Connor from Michael Boyd and litigation law firm in Dublin also criticise the state for taking so long to admit fault and liability for what happened.

She said liability was only accepted a few weeks before the case was due to be heard.
