Kneecap have vowed they will 'fight in court again' and that they will win again.
The band put out the statement after prosecutors announced they will appeal a UK court's decision to throw out the terrorism case against the band's Liam Og O hAnnaidh, also known as Mo Chara.
The 27-year-old was acquitted of flying a flag in support of Hezbollah at a gig last November due to a technical error.
Vincent McAvinney, a London based journalist says he could potentially end up back in court.
"At the moment, that's not clear. I think the CPS themselves feel they actually need clarification on this, particularly given what's going on at the moment with, for instance, support for Palestine Action which has now become a prescribed group as well.
"It sounds like they want full clarity of where they are in the law on this.
"There has been a strong reaction from Kneecap themselves in putting out a statement."
The statement from Kneecap reads:
"News of a CPS appeal against the ruling of their own judge is unsurprising.
"It is unsurprising, because the whole process has not been driven by the police or courts, it has been driven by politicians backed up by the British media.
"There is no important point of law. The CPS have submitted nothing new in their appeal. What there is though is a state wide witch-hunt against Palestinian solidarity.
"Once again there are endless news reports about Mo Chara, about Kneecap but we are NOT the story."
