Joshua Allen will find out in April if 15 month suspended sentence will be reactivated

The case against Joshua Allen of Ballinamona, Shanagarry was listed for re-entry this morning at Cork Circuit Criminal Court.

Joshua Allen’s barrister Donal O’Sullivan told the court that his client- who was not required to appear in court this morning- was appealing a “triggering offence”.

Allen was found guilty of possession of €280 of cocaine on the 10th of July 2020 at the Pontoon in Midleton by Judge Alec Gabbett in September last year.

Judge Gabbett jailed Allen for two months, however defence solicitor Don Ryan lodged an immediate appeal and bail was granted.

The conviction is a triggering offence for a 15 month suspended sentence, after Allen pleaded guilty to possession of over €22,000 worth of cannabis for sale or supply in 2019.

Judge Helen Boyle was told that an adjournment of the re-entry of the 2019 case was needed in order for the minor drugs case appeal to be heard in March.

The 2019 case is due to be heard on the 26th of April.
